JUDGMENT, A case was registered on the typed report/tahrir of the complainant Smt. Shafeek Bano against accused former Chairman of Municipality Azhar Khan, the then CO City Ale Hasan, Ranu Khan, Omendar Chauhan, SP Leader Firoz Khan, Zibran Khan, Contractor Barquat Ali and 20-25 unknown police personals as case crime No. 509/2019, in Police Station Ganj, District Rampur, under section 447, 452, 427, 504, 506 and 392 of Indian Penal Code (in short I.P.C.). In which two separate charge sheets have been filed under sections 447, 452, 427, 504, 506, 412, 120-B and 395 of IPC on which cognizance was taken by the Court. After cognizance, trial proceedings were started by this Court. Prosecution Case. The Prosecution case is that the complainant Smt Shafeek Bano, in the year 2012, had purchased 283 square meters land in Dungrupar police station Ganj, whose original registered documents are in her possession. And the complainant was living there after building a house. That on 03.02.2016 at around 08:15 pm, former Chairman of Municipality Azhar Khan, the then CO City Aley Hasan, Ranu Khan, Omendar Chauhan, SP leader Firoz Khan, Zibran Khan, contractor Barkat Ali and 20-25 unknown police personnel came to Dungpur Basti, and forcibly entered in the house of complainant and forcibly threw complainant’s family out of the house by abusing and threatening to kill her. Complainant pleaded a lot and showed the registry documents and the High Court's stay but the above mentioned accused did not agreed. They said that you are an opponent of Azam Khan, hence it is necessary to teach you a lesson, saying this, they broke the valuables kept in complainant’s house and drove a bulldozer on the entire house and looted the cash of about Rs. 9,000/- kept in the house. During this incident, Karamat Ali son of Nabi Jaan, resident of Electricity HouseNankar, Police Station Ganj, Rampur, Ahtesham Khan son of Aziz Ahmed Khan resident of Janata Coaching Jail Road Police Station Ganj, Rampur were present, as a witness. On the basis of typed complaint/tahrir (Ext. Ka-1) of the complainant Smt. Shafeek Bano, a case was registered against accused former Chairman of Municipality Azhar Khan, the then CO City Ale Hasan, Ranu Khan, Omendar Chauhan, SP Leader Firoz Khan, Zibran Khan, Contractor Barquat Ali and 20-25 unknown police personals as Case Crime Number 509/2019 under Sections 447, 452, 427, 504, 506 and 392 of IPC in Police Station Ganj District Rampur on 25.07.2019 at around 15:15 PM. While starting the investigation, the Investigating Officer inspected the place of incident and prepared a site plan. Ext. Ka-4. During the investigation by the investigating officer, the statements of the complainant and other independent witnesses were recorded under section 161 Cr.P.C. After completing all the formalities of investigation by the Investigating Officer, charge sheet (Ext. Ka-10) was filed against accused Mohammad Azam Khan, under section 447, 452, 427, 504, 506, 412, 120-B and 395 of IPC, and second charge sheet (Ext.
